Argentine courts to try Maradona doctors, nurses for homicide
Eight people who took care of soccer legend Diego Maradona will be tried in Argentina courts for homicide, according to a ruling released on Wednesday following an investigation into his November 2020 death due to cardiac arrest.
In the 236-page document seen by Reuters, the judge in charge of the case questioned “the behaviors – active or by omission – of each of the accused which led to and contributed to the realization of the harmful result.”
The ruling said that eight people including doctors, nurses and a psychologist who cared for Maradona at the time of his death are accused of “simple homicide,” a serious charge that means taking a life with intent.
A medical board appointed to investigate Maradona’s death concluded in 2021 that the soccer star’s medical team acted in an “inappropriate, deficient and reckless manner.”
Maradona was considered one of the greatest soccer players in history, though the diminutive player nicknamed “Pelusa” for his long mane of hair and “D10S” as a play on the Spanish word for “God” using his jersey number, battled drug and alcohol abuse for years.
Mario Baudry, a lawyer for one of Maradona’s sons, told Reuters that the World Cup winner was “in a situation of helplessness” by the time of his death. Maradona died on November 25, 2020, at the age of 60.
“As soon as I saw the cause, I said it was homicide. I fought for a long time and here we are, with this stage completed,” he said.
Argentine prosecutors launched investigations shortly after Maradona’s death at a house near Buenos Aires, including ordering searches of properties of his personal doctor and probing others involved in his care.
The defendants named in the ruling were Maradona’s neurosurgeon and personal doctor, Leopoldo Luque, psychiatrist Agustina Cosachov, psychologist Carlos Diaz, nurses Gisella Madrid and Ricardo Almiron, their boss Mariano Perroni, and doctors Pedro Di Spagna and Nancy Forlini.
The defendants have denied responsibility for Maradona’s death. The judge said that lawyers for some of them had requested the case be dismissed.
Vadim Mischanchuk, an attorney for Cosachov, said they would appeal the decision, adding the psychiatrist’s area of care had no relation with Maradona’s cause of death.
“A guilty party is being sought at all costs and objectivity is being lost,” the lawyer said.
Reuters could not immediately reach the defendants or the other lawyers for comment.
The crime of “simple homicide” in Argentina usually leads to a sentence of 8 to 25 years in prison, according to the country’s penal code. There is no set date for the trial yet.

Inter Miami will be the last club Argentina captain Lionel Messi plays for, the 36-year-old forward said on Wednesday, adding he feels “a little bit scared” at the thought of the day he decides to retire.
Messi, a World Cup winner with Argentina in 2022, has a contract with the Major League Soccer side until 2025 following his arrival last summer after a spell with French champions Paris St Germain.
“Inter Miami will be my last club. I love playing football. I enjoy everything even more because I am aware that there is less and less left,” Messi told ESPN.
“I’m not ready to leave football. I’ve done this all my life, I love playing football, I enjoy training, the day-to-day, the matches… And yes, there’s always a little bit of fear that it’s all over.”
The eight-time Ballon d’Or winner Messi is preparing with his national team to defend their Copa America title, with the tournament kicking off on June 20 in the United States.
Argentina will take on Canada in the opening match before facing Group A rivals Chile on June 25 and Peru four days later.

Bidding began on Wednesday for a napkin on which soccer club Barcelona penned a promise to sign a 13-year-old Lionel Messi – who went on to become one of the game’s greatest players – with early bids reaching almost $300,000.
The napkin was signed in December 2000 when Carles Rexach, then Barcelona’s sporting director, agreed with agent Horacio Gaggioli to recruit the Argentine teenager who went on to become the club’s all-time top scorer.
Bidding for the document, described by auction house Bonhams as “blue ink on a standard Spanish waxy napkin,” was at 220,000 pounds ($274,824.00) shortly after the sale opened, according to the auctioneer’s website.
The online sale closes on May 17 and has a guide price of between 300,000 and 500,000 pounds.
“It was never legally binding, but emotionally it represents the deep link or the beginning of the deep link, that Messi had with Barcelona,” said Bonhams Chief Marketing Officer Marc Sands.
Messi helped Barcelona win 35 titles, making a record 782 appearances and scoring 674 goals. Messi left Barcelona in 2021 and now plays for Inter Miami.
“If you love football, you’ll know all about Lionel Messi and you will know that he defined football for generations. If you want a slice of that action, this is the thing to get,” Sands said.
